Amended notes, looks like you are correct Keith. Behavior previously stated was of another insect nearby the was predatory (robber fly)

Hmm. The insect in the picture looks, to me, like a moth, specifically a Lichen Moth in the genus Lycomorpha. That, however, would be inconsistent with the behavior you have described.
