You were both correct. I ended up finding the owner who was very grateful considering she was moving out of state in two days.

I agree with Livan's comment - it's definitely someone's pet. Hopefully they can be reunited or someone gets the tortoise to a better home.

Seems to be a Yellow-footed Tortoise... and yes it would be a run away or discarded pet.
