Looks to be a juvenile American Goldfinch in winter plumage.

It may have finally been identified as common speedwell. It certainly seems right to me but I'm not very well practiced in flower identification. If anyone could confirm or deny this identification, please let me know!

Goshawk was the only one I thought for sure it wasn't =P after looking further into it when you suggested it, I think it's dead on. Thank you very much! We thought at first that it may have been injured, but when we tried to get too close it did fly. He was spotted near a house down the street from me and the man living there thought he may have flown into the house. He fed him a few times, and he is able to fly so hopefully, he's fine. =)
