More likely a Common Grackle (Quiscalus quiscala), but there isn't much to go by other than size and color here. :\
It is very hard to tell from your photo. It looks like there is a bird under the bench. If that is what you are talking about, then i would say it might be a crow. If you have some other photos it would help.
