Melospiza melodia
Medium-sized American sparrow. Body length ranges from 11 to 18 cm and wingspan can range from 18 to 25.4 cm.
It is found in most parts of the world. Woodlands, grasslands, deserts, and can live in urban or rural settings
It was cold outside when I took these pictures, that's why the bird is puffed up like that

Ok thank you both for your help
I think that I would have to agree with the song sparrow.
Certainly not a chipping sparrow, they have a clean breast other than a black spot, this bird has a lot of streaking. They would also have a white supercilium and a bright red cap.
This is not a house sparrow. It looks like a song sparrow, but it's so puffed up from the cold it's hard for me to tell.
