This monarch is injured. Forewings normally cover the hindwings and flight muscles push hindwings (therefore all wings) up and forewings (therefore all wings) down. By some trauma, this insect has its hindwings forced above the forewings and would be unable to fly. Check a healthy one here http://www.projectnoah.org/spottings/166...

@LuckyLogan they are very similar but Viceroy has a line across the hind wings which is not present on this specimen.
