The flower in the background of pic 2 appears to have 5 petals

odd flower. An essential part of the Solanaceous/nightshade family is the 5 petal like flower. Too bad you cant see it now and break a leaf or two and see if it has a very strong smell typical of these. Also small fruit clusters, red, purple, black-like and combinations.

It does look like Solanum panduraeiforme, perhaps the four petalled flower is just by chance.

So very similar to the Solanum panduriforme, but your spotting only have four petals instead of five... hmm...
