It appears to be a cultivated variety of holly (Ilex sp.), or perhaps an introduced species that I am unfamiliar with. You can see that some of the leaves have the spines characteristic of American holly (I. americana). Hollies are dioecious--there are separate male and female trees. This one has fruit so it's a female.
