I think its either a ring necked duck or the mentioned, tufted duck. They both look pretty similar.

I think it might actually be a black-tailed deer. Both inhabit the same range, but I couldn't find any mule deers with pure brown/black tails.

I actually think its a douglas fir upon closer inspection.
