Very small fly. Shiny black body, clear wings, red eyes. Resembles a large fruit fly or vinegar fly.

Habitat:

Suburban backyard garden, resting on an Oriental Maple tree.

Notes:

This little fly was so shiny you can see my reflection on him/her! Xenochaetina is the nearest match I could find for this fly.
