In New York, the only lagamorphs it could be are Eastern Cottontail, New England Cottontail, or Snowshoe Hare. Since it's obviously not a Snowshoe Hare (white tail, pale coloration), it has to be either Eastern or New England Cottontail. New England Cottontail is out of range for Albany, so it must be an Eastern Cottontail.
