According to this, a nutria has a steeply-arched back, and a round tail. Eyes/ears set high on the head.

In this picture, it is impossible to tell, but it seems the back is arched. Can't determine the face at all, can barely see the tail. Flip a coin. I'm not placing a bet on either! lol

Muskrat : laterally flattened tail, small eyes, very short, rounded ears.

If the tail was round, it is a nutria. If it was flattened laterally, it is a muskrat.

From the poor quality picture, it looks like it has a sorta short tail? If so, and since it's near a pond, it could be a muskrat.
