Fortunately it looks like some kids painted it - and if kids had access to the paint its probably non-toxic. What's actually a little funny is that I think this IS a Painted Turtle (Chrysemys picta) LOL...
Nathan, I'm not sure who painted the turtle, my wife and kids found it in the middle of the street so they grabbed him and moved him to the pond nearby and it washed right off as he swam away. We love to see animals but would never touch them (unless moving out of harms way like this) and certainly would not paint on any.
