The snake is a gardener snake, they aren't poisonous but if you pick it up it will make your fingers stink really bad!

This is either an Alder or a Maple, you have to look at it's leaves. I have tons of these around my house :)

I know it's a bald eagle because after I took the pic it landed and I got a better look at it. But maybe you're right.
