As far as I know, Shikra is the globally accepted name. I can't find any nomenclature on Accipiter badius stating 'Common Indian Accipiter'.

Definitely not a Milvus migrans, the tail, posture, beak, breast, and patterning is off. I would say it's an Accipiter, probably a subadult Shikra (Accipiter badius), though I can't find one as rufous as your bird.
