You could very well be right it would make more sense than a Harlan's I didn't see the tail and it certainly looks dark in the picture, however a Harlan's was seen in the same location I got the picture maybe it's a coincidence.
I wonder if this isn't just a dark morph red-tailed hawk. Harlan's hawks have white tails...
